Welcome to Ávita Care. These Terms of Use establish the general conditions applicable to the use of our regulatory hosting services. By using our services, you agree to these terms and our Privacy Policy.

1. Acceptance of Terms

By accessing and using Ávita Care services, you agree to these Terms of Use.

If you do not agree with any part of these terms, you should not use our services.

We reserve the right to modify these terms at any time, with prior notification to users.

2. Description of Services

Ávita Care offers regulatory hosting services, including:

• Legal representation before ANVISA

• Regulatory technical responsibility

• Product registration management

• Compliance and regulatory adequacy

• Technical documentation storage and management

Our services are intended exclusively for companies and professionals in the regulated sector.

3. Client Responsibilities

The client commits to:

• Provide true, accurate and updated information

• Maintain the confidentiality of access credentials

• Use services in compliance with Brazilian legislation

• Immediately report any unauthorized use of their account

• Ensure products and documents comply with regulations

• Make payments within established deadlines

4. Ávita Care Responsibilities

Ávita Care commits to:

• Provide quality and professional services

• Maintain CBPDA — ANVISA Good Practices certification

• Protect data according to LGPD and security standards

• Notify about relevant regulatory changes

• Maintain system backup and availability

Liability limitations:

• We are not responsible for incorrect information provided by the client

• We do not guarantee registration approval by ANVISA

• We are not responsible for regulatory decisions of government bodies

5. Prohibited Use

It is expressly prohibited to:

• Use services for illegal or unauthorized activities

• Attempt to access systems or data without authorization

• Transmit viruses, malware or malicious code

• Reverse engineer our systems

• Use our services for counterfeit or smuggled products

• Violate third-party intellectual property rights

• Share access credentials with unauthorized third parties

6. Payments and Renewal

Commercial conditions:

• Values will be as per accepted commercial proposal

• Payments must be made on agreed dates

• Delay exceeding 30 days may result in service suspension

• Automatic renewal upon prior agreement

• Annual adjustments according to IGPM or agreed index

• No refund for services already provided or in progress

7. Termination and Cancellation

Termination conditions:

• The client may cancel with 30 days prior notice

• Ávita Care may terminate in case of violation of these terms

• In case of termination, the client must settle pending matters

• Data will be kept according to regulatory obligations (minimum 5 years)

• Documentation may be made available upon formal request

• No termination penalty, except if provided in a specific contract

8. Intellectual Property

All intellectual property rights related to the Ávita Care website, platforms and materials are exclusively owned by Grupo Soluto.

Reproduction, distribution or modification of any content without prior written authorization is prohibited.

Technical documentation and product registrations remain the property of the client.

9. Limitation of Liability

Ávita Care will not be liable for:

• Indirect, incidental or consequential damages

• Loss of profits or business opportunities

• Unavailability of third-party services (ANVISA, postal services)

• Regulatory decisions or changes in legislation

• Force majeure or unforeseeable circumstances

Our maximum liability will be limited to the amount paid for services in the last 12 months.

10. Applicable Law and Jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil.

The courts of Vinhedo - SP are elected to resolve any issues arising from these terms, with express waiver of any other, however privileged.

In case of conflict between these Terms of Use and a specific contract, the specific contract will prevail.
